Forcible Transfer of Protected Populations

International humanitarian law (IHL) sets out a very strict prohibition on forcible transfer for which there are no exceptions. In the context of the oPt many individuals and communities have or are at risk of being forcibly transferred.


In the context of the oPt whenever the illegal settlement policies are condemned it is also important to remain aware of the other side of the coin: the displacement of communities, particularly in Area C and East Jerusalem.

Forcible transfer is strictlty prohibted under Article 49 of the Fourth Geneva Convention (GCIV). Furthermore a violation of Article 49 is deemed to be a grave breach under Article 147 GCIV.
