Israeli Archeology Policies in the West Bank

7 April 2016

This study summarises the historical background and relevant legal frameworks on Israeli archeology policies in the West Bank.

The legal analysis will touch upon both the institutional and operational aspects of Israel’s West Bank archaeological activities — activities that have more recently received the attention they have long deserved.

This analysis includes the examination of the legality and impact of these activities of the occupying power on the development of the occupied Palestinian territory (oPt), with a particular focus on the cultural rights of the Palestinian people.

The paper also elaborates on the main Israeli and Palestinian positions, followed by the obligations of third parties in relation to violations of international law in the oPt. It will end with conclusions and recommendations to Israel, Palestine and the international community.
